Terms of Service
These draft terms describe the rules for using I'm open 2, a private social planning service operated by Arbitrary Systems LLC. They are written for our product as it works today and should be reviewed by counsel before broad launch.
Last updated: May 14, 2026
1. Agreement
These Terms of Service are an agreement between you and Arbitrary Systems LLC ("Arbitrary Systems," "we," "us," or "our") for your access to and use of I'm open 2, including our website, app, features, communications, and related services.
By creating an account, accessing the app, starting a subscription, or otherwise using I'm open 2, you agree to these Terms and to our Privacy Policy and Community Guidelines. If you do not agree, do not use the service.
2. Who Can Use I'm Open 2
I'm open 2 is intended for adults. You must be at least 18 years old and legally able to enter into a contract to use the service. You may not use I'm open 2 if applicable law prohibits you from doing so or if we have previously removed or suspended your account for serious or repeated violations.
You are responsible for providing accurate account information, keeping your login credentials secure, and maintaining access to the email address associated with your account. We may require email verification before allowing access to the main app.
3. The Service
I'm open 2 helps people make private, short-term plans through invite-only circles. A user can create a Pulse saying what they are open to, other circle members can Echo if they are also open 2, and the pulser can turn that interest into a Sync.
The service is designed around privacy, boundaries, and short-lived planning. Pulses expire in the product, but expiration is not a promise that every related record, backup, security log, notification, email, or audit entry is instantly deleted. We may retain information as described in our Privacy Policy and as needed to operate, secure, support, and improve the service.
4. Circles, Invites, Pulses, Echos, and Syncs
You choose the circles that receive a Pulse. Circle membership, invitation links, QR codes, blocking, muted circles, Social Pulse settings, and notification preferences are tools to help you manage your own boundaries.
You are responsible for the plans you create, accept, decline, host, organize, or attend. We do not verify the identity, background, intentions, location, or offline conduct of users. Use judgment when meeting people in person, especially if you do not already know them well.
5. Your Content and Permissions
You retain ownership of the content you submit to I'm open 2, such as profile information, circle names, Pulse text, availability windows, feedback, and messages submitted through support or feedback forms.
You give us a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, process, and modify your content only as needed to provide, secure, support, and improve the service. You represent that you have the rights needed to submit your content and that your content does not violate the rights of another person.
6. Acceptable Use
You agree not to misuse the service or help anyone else misuse it. This includes harassment, stalking, threats, hate or discriminatory conduct, impersonation, scams, spam, doxxing, scraping, unauthorized access, attempts to bypass account restrictions, or use of the service for unlawful, unsafe, or exploitative activity.
Our Community Guidelines are part of these Terms. We may remove content, restrict features, disable invites, suspend accounts, terminate accounts, or contact appropriate authorities when we believe it is necessary to protect users, the service, Arbitrary Systems, or others.
7. Paid Plans, Renewals, and Cancellation
I'm open 2 offers a free tier and paid tiers, including Supporter and Organizer. Supporter is currently planned at $2/month through August 2026, then $3/month after that, with annual options at $24 and $30. Organizer is currently planned at $7/month or $70/year. Pricing, features, limits, and promotional offers may change over time.
Payments are processed by Stripe. Paid plans renew automatically unless cancelled before the renewal date. When you cancel, you generally keep paid access until the end of the current billing period. Unless required by law or expressly stated in an offer, fees are non-refundable and we do not provide prorated refunds.
You are responsible for applicable taxes, billing information, and charges from your bank, card issuer, mobile carrier, or other providers. If payment fails, we may retry payment, limit paid features, or move your account to a free or inactive state.
8. Notifications and Third-Party Services
I'm open 2 may send service emails, feedback responses, Pulse notices, Echo notices, Sync details, reminders, and calendar invitations depending on your settings and the features you use. Some notices are transactional and may be sent even if you opt out of marketing.
We use third-party providers to operate the service, such as hosting, database, email, payment, calendar, and authentication providers. Your use of those connected services may also be governed by their own terms and privacy policies.
9. Our Intellectual Property
I'm open 2, Arbitrary Systems, the product language, logos, designs, software, and other service materials are owned by Arbitrary Systems or its licensors. These Terms do not give you ownership of our intellectual property or permission to copy, modify, reverse engineer, sell, or exploit the service except as allowed by law or with our written permission.
10. Feedback
If you submit feedback, ideas, suggestions, bug reports, or feature requests, you allow us to use them without restriction or compensation. Feedback is a gift, and we appreciate it.
11. Account Suspension and Termination
You may stop using the service at any time. We may suspend or terminate access, remove content, or restrict features if we believe you violated these Terms, created risk for another user, used the service unlawfully, or acted in a way that harms the service or community.
12. Disclaimers and Limits on Liability
I'm open 2 is provided "as is" and "as available." We do not promise that the service will be uninterrupted, error-free, secure, or that every Pulse, Echo, Sync, invite, notification, or calendar event will work exactly as expected.
To the fullest extent allowed by law, Arbitrary Systems will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, personal injury, offline conduct, or damages arising from interactions between users.
13. Changes
We may update these Terms as the service changes or as legal requirements change. If changes are material, we will take reasonable steps to notify you. Continued use after the effective date of updated Terms means you accept the updated Terms.
